LAHORE: Lahore High Court (LHC) restored Chaudhary Parvez Elahi to the position of Chief Minister of Punjab, on Friday, after he assured the court that he won’t dissolve the Punjab Assembly. LHC suspended the notification of the Governor.
The development came after Elahi submitted a petition against the de-notifying notice issued by Governor of Punjab Muhammad Baligh-ur-Rehman.
The five members’ larger bench headed by Justice Abid Sheikh heard the petition of Elahi and decided to restore Elahi to his office.
According to the written order issued by LHC, the notices are issued to the concerned parties on the important legal points raised in the petition.
However, the court said, “We are not restricting CM to taking a trust vote, and restoring the CM-ship of Mr. Elahi and his cabinet as well.”
“The counsel of Elahi promised that he won’t dissolve the assembly so that the de-notification order by the governor is suspended,” said the written order.
As the court order read, “Chaudhary Parvez Elahi said in an affidavit that he will not advise dissolving the assembly, the court order does not forestall Elahi to take a trust vote.
Elahi Stance On Dissolution of Assembly
Despite ensuring the court, Elahi said the decision regarding the dissolution of assemblies is final, and Imran Khan’s decision will be fully implemented.
“The Court Proves, PTI’s Stance Was Right,” says Fawad Chaudhary
Meanwhile, shortly after the court order was issued in a press conference Chaudhary Fawad Hussain, the former information minister of the PTI government said, “The court has proved today that the PTI’s stance was right, and it nullified the governor’s notification to remove Elahi.”
“Elahi was ready to take the vote of confidence…. maybe he would ask the speaker to summon a session in regards to this within a week,” said Fawad, adding, “Our only demand was that the session takes place once our lawmakers, who are abroad, return.”
Hence, the senior PTI leader added that Punjab Assembly Speaker Sibtain Khan would write a letter to President Arif Alvi for the removal of the Governor.
